Insured’s Flooding Was Not Caused By Contractors, New York Justice Says
(February 23, 2016, 2:52 PM EST) -- NEW YORK — Work performed by a general contractor and its independent contractor at a demolition site did not cause flooding to an insured’s premises, a New York justice ruled Feb. 16, dismissing negligence claims against a subrogated insurer (Jewelers Mutual Insurance Co. v. Structure Tone, Inc. and Rite-Way Internal Removal, Inc., No. 157372/2012, N.Y. Sup., New York Co.; 2016 N.Y. Misc. LEXIS 485).
