In 2-1 Ruling, 6th Circuit Retains Jurisdiction Over Clean Water Rule Cases
Mealey's (February 23, 2016, 2:44 PM EST) -- CINCINNATI — In a fractured 2-1 ruling, the Sixth Circuit U.S. Court of Appeals on Feb. 22 ruled that the court has subject matter jurisdiction over 22 cases challenging the Clean Water Rule (In Re: United States Department of Defense and Environmental Protection Agency Final Rule: Clean Water Rule: Definition of “Waters of the United States,” Nos. 15-3751, et al., 6th Cir.; 2016 U.S. App. LEXIS 3031).
