Insured: Court Should Have Rejected Magistrate’s ‘Sledgehammer Approach’
Mealey's (February 23, 2016, 2:31 PM EST) -- BOSTON — An insured has asked the First Circuit U.S. Court of Appeals to reverse a lower federal court’s ruling that adopted a magistrate’s report in favor of an insurer in a dispute over insurance practices involving the repair of his car (Jose David Aleman-Pacheco v. Universal Group Inc., et al., No. 15-1565, 1st Cir.).
On June 12, 2013, José David Aleman–Pacheco sued Universal Group Inc. and Universal Insurance Co. (collectively, Universal) for breach of contract and breach of contract with malice.
