Ecstasy Use, Stroke Cause Appealed To 5th Circuit In Breach-Of-Contract Suit
(February 23, 2016, 8:43 AM EST) -- NEW ORLEANS — The Fifth Circuit U.S. Court of Appeals has been asked to rule that an insured’s ingestion of the drug ecstasy does not trigger exclusion of claims for the insured’s stroke as the illegal use of a narcotic or for intoxication (Eleanor Crose, et al. v. Humana Insurance Company, No. 15-50559, 5th Cir.).
Ronald Crose had a health insurance policy issued by Humana Insurance Co. In June 2013, Crose suffered an intracranial hemorrhage that resulted in serious mental and physical injury.
