Lawyer To 9th Circuit: Approval Of Stipulation Barring Trust Claims Was Error

(February 19, 2016, 2:55 PM EST) -- LOS ANGELES — A California federal bankruptcy judge erred by failing to apply the correct legal standard to determine whether a stipulated agreement under which an attorney must stop filing claims with two asbestos personal injury trusts is valid under California law, the attorney tells the Ninth Circuit U.S. Court of Appeals in a Jan. 25 opening brief (Michael J. Mandelbrot, et al. v. J.T. Thorpe Settlement Trust and Thorpe Insulation Company Asbestos Settlement Trust, No. 15-56430, 9th Cir.).
