New York Panel OKs Public Use Of Navigable Waterway Located On Private Land
Mealey's (June 17, 2015, 12:51 PM EDT) -- ALBANY, N.Y. — A split New York state appeals panel on Jan. 15 affirmed a trial court’s finding that waterways on private property are navigable-in-fact under New York law and can be used by canoeists traversing waterways in an adjoining state wilderness area (Friends of Thayer Lake LLC, et al. v. Phil Brown, et al., No. 518309, N.Y. Sup., App. Div., 3rd Dept.; 2015 N.Y. App. Div. LEXIS 398).
