Program Restructuring Claims Against Government Proper, Tribe Argues

(February 10, 2016, 8:41 AM EST) -- SIOUX FALLS, S.D. — A South Dakota federal court has subject matter jurisdiction to hear the Cheyenne River Sioux Tribe’s request to halt a restructuring of the Bureau of Indian Education (BIE), and the tribe’s claims against the federal government are ripe for review, the tribe argues in a Jan. 15 brief opposing the government’s motion to dismiss the case (Cheyenne River Sioux Tribe v. Sally Jewell, et al., No. 15-3018, D. S.D.).
