Judge: Plaintiff Insurer Properly Discharged Burden In Declaratory Relief Suit
(February 5, 2016, 11:43 AM EST) -- GRAND RAPIDS, Mich. — A federal judge in Michigan on Jan. 26 granted summary judgment in favor of an insurer in a declaratory relief suit over coverage for an automobile accident, ruling that the insurer had properly “discharged its burden” under the Federal Rules of Civil Procedure (Home-Owners Insurance Co. v. Allied Property and Casualty Insurance Co., et al., No. 14-467, W.D. Mich.; 2016 U.S. Dist. LEXIS 11246).
