7th Circuit Affirms Dismissal Of Generic Drug Claim On Federal Preemption

Mealey's (February 4, 2016, 1:31 PM EST) -- CHICAGO — A federal appeals court panel on Feb. 3 affirmed the dismissal of a plaintiff’s claims against Qualitest Pharmaceuticals Inc., finding that his claims involving the generic drug allopurinol are preempted (Michael Houston v. United States of America, et al., No. 15-2411, 7th Cir.; 2016 U.S. App. LEXIS 1762).
