Retroactive Common Benefit Fee In Morcellator MDL Opposed By Defendant, Attorneys
(February 3, 2016, 12:34 PM EST) -- KANSAS CITY, Kan. — The defendant, a competitor and even some plaintiffs in the Ethicon morcellator multidistrict litigation on Jan. 21 opposed a proposed common benefit fee order that would be retroactive to cases that have previously settled or that were in the process of settling when the MDL was formed (In Re: Ethicon, Inc., Power Morcellator Products Liability Litigation, MDL Docket No. 2362, No. 15-2652, D. Kan.).
