Subclasses Certified In Costco Hepatitis A Infections Suit
(February 3, 2016, 8:02 AM EST) -- SANTA ANA, Calif. — A California federal judge on Jan. 25 granted a motion for class certification in a suit alleging injury from consuming hepatitis A-tainted frozen berry mix but ordered that the plaintiffs must proceed with proposed single-state subclasses in order to overcome state law variation problems (Jacob Petersen, et al. v. Costco Wholesale Co., Inc., et al., No. 13-1292, C.D. Calif.; 2016 U.S. Dist. LEXIS 9030).
