5th Circuit Reverses, Says Foreseeable Analysis Was Flawed

(February 3, 2016, 7:35 AM EST) -- NEW ORLEANS — A gunshot victim can proceed with allegations that the property manager of his apartment complex failed to protect him from unreasonable and foreseeable harm, the Fifth Circuit U.S. Court of Appeals ruled Jan. 26 (Shannon Jenkins v. C.R.E.S. Management LLC, No. 14-20609, 5th Cir.; 2016 U.S. App. LEXIS 1238).
