Panel Affirms Ruling In Insurer’s Favor In Suit Over Plant Pathogen Outbreak
(February 2, 2016, 11:50 AM EST) -- SAN JOSE, Calif. — A California appeals panel on Jan. 14 affirmed a lower court’s ruling in favor of an excess liability insurer in a breach of contract, bad faith and negligence lawsuit seeking coverage for the insured’s alleged $3.5 million loss caused by a plant pathogen outbreak (Goldsmith Seeds v. Great American Insurance Co., No. H037791, Calif. App., 6th Dist.; 2016 Cal. App. Unpub. LEXIS 241).
