California Federal Judge Finds Sovereign Immunity Bars Collection Action

Mealey's (June 17, 2015, 10:33 AM EDT) -- SACRAMENTO, Calif. — In Blue Lake Rancheria’s dispute with the California Employment Development Department (EDD) over reimbursement allegedly owed by the tribe to the state for unemployment insurance, a federal judge in California on May 12 held that sovereign immunity of a Native American tribe applies to tax enforcement actions and also bars such actions no matter where the assets of the tribe are located (Blue Lake Rancheria v.
