California Federal Judge Finds Sovereign Immunity Bars Collection Action

Mealey's (June 17, 2015, 10:33 AM EDT) -- SACRAMENTO, Calif. — In Blue Lake Rancheria’s dispute with the California Employment Development Department (EDD) over reimbursement allegedly owed by the tribe to the state for unemployment insurance, a federal judge in California on May 12 held that sovereign immunity of a Native American tribe applies to tax enforcement actions and also bars such actions no matter where the assets of the tribe are located (Blue Lake Rancheria v. David Lanier, No. 11-1124, E.D. Calif.; 2015 U.S. Dist. LEXIS 62944).
