(January 29, 2016, 9:25 AM EST) -- ABERDEEN, Miss. — A federal orthopedic device plaintiff on Jan. 25 filed a notice of appeal of a Mississippi federal judge’s Jan. 14 order granting summary judgment in a spinal device case after finding that the plaintiff’s remaining claim of alleged failure to get federal approval is preempted (Rocky Estes v. Lanx, Inc., et al., No. 14-52, N.D. Miss., Aberdeen Div.; 2016 U.S. Dist. LEXIS 4857).
