Zimmer Opposes High Court Reinstatement Of Enhanced Damages Award In Patent Suit

Mealey's (January 28, 2016, 4:34 PM EST) -- WASHINGTON, D.C. — The U.S. Supreme Court should decline to reinstate an award of enhanced damages under 35 U.S. Code Section 284 in a patent infringement lawsuit or remand to allow an appellate court to determine whether the district court abused its discretion in enhancing damages and awarding fees, Zimmer Inc. and its subsidiaries argue in an opposition brief filed Jan. 13 (Stryker Corp., et al. v. Zimmer, Inc., et al., No. 14-1520, U.S. Sup.).
