10th Circuit Won’t Stay Order To Restore Wyoming River For CWA Violation

Mealey's (June 17, 2015, 10:25 AM EDT) -- DENVER — The 10th Circuit U.S. Court of Appeals on April 28 denied a motion by the LeClair Irrigation District to stay a lower court order to restore a river’s course pending appeal of a federal Clean Water Act (CWA) violation (United States of America, et al. v. LeClair Irrigation District, et al., No. 14-8086, United States of America, et al. v. John Hubenka, No. 14-8091 and United States of America, et al. v. LeClair Irrigation District, et al., No. 14-8093, 10th Cir.).
