Coverage Owed For Lead Paint Suit; Coverage Denial Was Not Timely, Justice Says

(January 26, 2016, 12:25 PM EST) -- NEW YORK — An insurer must defend the City of New York in a suit alleging injuries caused by lead paint exposure because the insurer failed to timely disclaim coverage for the suit filed against the city and others, a New York County Supreme Court justice said Jan. 15 (Robert Vargas, et al. v. The City of New York, et al., No. 154323/13, N.Y. Sup.; 2016 N.Y. Misc. LEXIS 153).
