Judge Denies Dismissal To MTBE Defendant; Service Was Not Insufficient

Mealey's (January 25, 2016, 2:43 PM EST) -- NEW YORK — The federal judge in New York presiding over litigation regarding groundwater allegedly contaminated by the gasoline additive methyl tertiary butyl ether (MTBE) on Jan. 21 denied a motion to dismiss the complaint, ruling that while one of the defendants has never affirmatively indicated that it had been served, it remained silent for more than a year and has participated in the litigation (In re: Methyl Tertiary Butyl Ether [MTBE] Products Liability Litigation, MDL 1358, No. 00-1898, Commonwealth of Pennsylvania v.
