Water Rights Don’t Trump Federal Grazing Permits, 9th Circuit Panel Rules

Mealey's (January 25, 2016, 2:07 PM EST) -- SAN FRANCISCO — A ranch that holds water rights on federal land must still apply for a grazing permit, the Ninth Circuit U.S. Court of Appeals ruled Jan. 15 in reversing judgment in favor of the ranch, reversing a counterclaim against the federal government and reversing a trial judge’s contempt finding against two federal employees (United States of America v. Estate of E. Wayne Hage, et al., No. 13-16974, 9th Cir.; 2016 U.S. App. 773 and 2016 U.S. App. 762).
