Judge Dismisses Borrower's Claims For Violation Of Texas Constitution

(January 22, 2016, 9:55 AM EST) -- DALLAS — A Texas federal judge on Jan. 20 granted a bank's motion to dismiss claims asserted by property owners for violation of the Texas Constitution, finding that their claims were time-barred and unsupported (Dan Spence and Fortezza Enterprises Inc. v. Flagstar Bank F.S.B., No. 3:15-CV-3643, 2016 U.S. Dist. LEXIS 6332).
