Judge Allows Claims For Misleading Mulch Packaging Against Lowe’s

(January 21, 2016, 2:17 PM EST) -- FRESNO, Calif. — After finding that a purchaser's allegations were sufficient to support his claims that Lowe’s Home Centers LLC and another entity violated California's Unfair Competition Law (UCL) and committed fraud when they participated in a scheme to short-package bags of mulch, a California federal judge on Jan. 19 denied a motion to dismiss the case (Glenn McMillan, individually and on behalf of all others similarly situated, v. Lowe’s Home Centers LLC, et al., No. 1:15-CV-00695, E.D. Calif.; 2016 U.S. Dist. LEXIS 6673).
