5th Circuit Claims For Violation Of Texas Finance Code Are Not Actionable

(January 20, 2016, 1:45 PM EST) -- NEW ORLEANS — The Fifth Circuit U.S. Court of Appeals on Jan. 15 affirmed a district court's decision to grant judgment in favor of a bank on claims that it violated the Texas Debt Collection Act (TDCA), finding that any of the alleged misrepresentations made by the bank were actionable (Alfred Fields, et al. v. JP Morgan Chase N.A., No. 15-10034, 5th Cir.; 2016 U.S. App. LEXIS 717).
