JMOL Sought In Children’s Tylenol Death Retrial After Evidence Discarded

(January 19, 2016, 2:35 PM EST) -- LOS ANGELES — Johnson & Johnson subsidiary McNeil-PPC Inc. on Jan. 15 asked a California federal court for judgment as a matter of law (JMOL) in the retrial of a contaminated Children’s Liquid Tylenol wrongful death case, saying there is no evidence of bacterial contamination or evidence that the bacteria caused a boy’s death, in part because a testing lab discarded the allegedly contaminated product prior to retrial (Peter Robertson, et al. v.
