D.C. Circuit Panel Finds District Court Erred, Reinstates Menthol Committee

(January 19, 2016, 1:48 PM EST) -- WASHINGTON D.C. — A District of Columbia Circuit U.S. Court of Appeals panel on Jan. 15 reinstated a panel created by the Food and Drug Administration to report on menthol cigarettes after finding that a tobacco company’s concerns relating to alleged conflicts of interests of three committee members were too uncertain to dismantle the committee (R.J. Reynolds, et al. v. Food Drug Administration, No. 14-5226, D.C. Cir.; 2016 U.S. App. LEXIS 631).
