9th Circuit Affirms Dismissal Of Tribe’s Suit Over Health Care Facilities

Mealey's (June 17, 2015, 9:59 AM EDT) -- SAN FRANCISCO — In an unpublished opinion, a panel of the Ninth Circuit U.S. Court of Appeals on April 1 affirmed the dismissal of a complaint brought by the Quechan Tribe of the Fort Yuma Indian Reservation against the federal government for allegedly providing inadequate health care and failing to keep up the tribe’s health care facilities, saying no federal-tribal trust relationship exists creating a judicially enforceable duty (Quechan Tribe of the Fort Yuma Indian Reservation v.
