Florida Appeals Panel Reverses Punitive Award, Fraud Claims In Tobacco Case

(January 15, 2016, 8:28 AM EST) -- WEST PALM BEACH, Fla. — A divided Florida appeals panel on Jan. 6 reversed a $54.85 million punitive damages award against three tobacco companies after reversing judgment on fraudulent concealment and conspiracy to commit fraudulent concealment claims brought by the estate of a man who died from a smoking-related illness (R.J. Reynolds Tobacco Company, et al. v. Marvine Calloway, as Personal Representative of the Estate of Johnnie Calloway, No. 4D12-3337, Fla. App., 4th Dist.; 2016 Fla. App. LEXIS 225).
