Florida Panel Certifies Engle Preemption Question To State Supreme Court

(January 15, 2016, 8:25 AM EST) -- WEST PALM BEACH, Fla. — After affirming judgment for a man who sued R.J. Reynolds Tobacco Co. after his father died from a smoking-related illness, a Florida appellate panel on Jan. 6 certified to the Florida Supreme Court a question regarding whether federal law preempts state strict liability and negligence claims against tobacco companies in Engle progeny cases (R.J. Reynolds Tobacco Co. v. Phil J. Marotta, No. 4D13-1703, Fla. App., 4th Dist.; 2016 Fla. App. LEXIS 222).
