5th Circuit Reinstates Employee’s Wage Claims Against Company Owner
(January 14, 2016, 11:34 AM EST) -- NEW ORLEANS — An employee whose wage claims against his former employer, the company, were partially discharged in bankruptcy proceedings, is not barred by the debtor’s reorganization plan from proceeding against the company owner individually, the Fifth Circuit U.S. Court of Appeals ruled Jan. 5 (Jose E. Hernandez, et al. v. Larry Miller Roofing, Incorporated, et al., No. 15-10287, 5th Cir.; 2016 U.S. App. LEXIS 204).
