Alexsam Argues Appeals Court Had No Jurisdiction To Rule Patent Claims Were Anticipated
(January 13, 2016, 11:19 AM EST) -- WASHINGTON, D.C. — An appellate court erred in considering a decision denying The Gap Inc. and Direct Consumer Services LLC judgment as a matter of law (JMOL) that two patents are invalid as anticipated, Alexsam Inc. says in a petition filed Dec. 7 with the U.S. Supreme Court, further arguing that the court lacked subject matter jurisdiction (Alexsam, Inc. v. The Gap, Inc. and Direct Consumer Services, No. 15-736, U.S. Sup.).
