Owned Property Exclusion Bars Coverage For Cleanup Costs, Federal Judge Says
Mealey's (January 12, 2016, 12:27 PM EST) -- ALBUQUERQUE, N.M. — A New Mexico federal judge on Dec. 30 granted an insurer’s motion to dismiss its insured’s seeking coverage for environmental contamination cleanup costs because the policy’s owned property exclusion clearly applies as a bar to coverage (Taos Ski Valley Inc. v. Nova Casualty Co., No. 15-00323, D. N.M.; 2015 U.S. Dist. LEXIS 174062).
