Tennessee Federal Magistrate Says No Coverage Owed For Tenant’s Mold Injuries
(January 12, 2016, 12:25 PM EST) -- KNOXVILLE, Tenn. — An insurer has no duty to defend or indemnify its insureds against an underlying suit alleging injuries arising out of mold exposure within a rental property because the landlord policy at issue clearly bars coverage for injuries and damages caused by mold, a Tennessee federal magistrate judge said Dec. 22 (Allstate Insurance Co. v. Joe Mawhinney, et al., No. 15-121,. E.D. Tenn.; 2015 U.S. Dist. LEXIS 170961).
