Punitive Damages Claim Stands In Falling Cabinet Wrongful Death Suit

(January 11, 2016, 4:17 PM EST) -- ORLANDO, Fla. — A federal judge in Florida on Jan. 5 denied a furniture retailer’s motion for partial summary judgment on a punitive damages claim against it, finding that the plaintiff produced “substantial affirmative evidence” to allow a rational jury to conclude that the retailer was grossly negligent in selling a cabinet that posed an obvious tipping hazard (Amanda White, as Personal Representative for the Estate of Landon White v. American Signature, Inc., No. 6:14-cv-1638-Orl-40GJK, M.D. Fla., Orlando Div.; 2016 U.S. Dist. LEXIS 494).
