Illinois Appeals Court: Ditch Is Natural Watercourse, Can’t Be Obstructed
Mealey's (June 17, 2015, 9:19 AM EDT) -- SPRINGFIELD, Ill. — A ditch that drains water off a farm and across a neighbor’s property is a natural watercourse that the neighbor must not obstruct and must permit maintenance of, an Illinois state appeals panel ruled Nov. 25, 2014, in reversing a lower court finding (The Lester Eugene Kenady Revocable Living Trust, et al. v. Michael Baker, No. 4:13-1059, Ill. App., 4th Dist.; 2014 Ill. App. Unpub. LEXIS 2660).
