Federal Judge Dismisses Breach Of Fiduciary Claims; Adequate Remedy Available
(January 8, 2016, 10:30 AM EST) -- HARRISBURG, Pa. — Because a disability claimant’s complaint alleges an injury for which Section 1132(a)(1)(B) of the Employee Retirement Income Security Act provides an adequate remedy, a Pennsylvania federal judge on Dec. 8 dismissed the plaintiff’s claims for breach of fiduciary duty and disgorgement (Yvonne Hilbert v. The Lincoln National Life Insurance Co., No. 15-471, M.D. Pa.; 2015 U.S. Dist. LEXIS 163908).
