11th Circuit Finds Fact Issues Exist On Fraud Claim, Reverses Judgment

(January 7, 2016, 2:05 PM EST) -- ATLANTA — The 11th Circuit U.S. Court of Appeals on Jan. 4 affirmed judgment for a bank on a property owner's claims for tortious conversion and trespass, but reversed a decision to grant summary judgment on her claim for fraud, finding that a genuine issue of fact exists as to whether the bank made false representations in relation to the status of the property and foreclosure (Gina McClain v. Bank of America, N.A., No. 15-11810, 11th Cir.; 2016 U.S. App. LEXIS 93).
