Texas City Can’t Condemn Private Water Utility, Appeals Court Says

Mealey's (June 17, 2015, 8:41 AM EDT) -- FORT WORTH, Texas — A Texas state appeals panel on Nov. 13, 2014, affirmed summary judgment that a city cannot condemn a privately owned water company that is a going concern (City of Blue Mound, Texas v. Southwest Water Company, et al., No. 02-13-00343-CV, Texas App., 2nd Dist., Fort Worth; 2014 Tex. Ap. LEXIS 12347).
