Denial Of Disability Claim Was Not Abuse Of Discretion, 5th Circuit Panel Finds

(January 7, 2016, 11:56 AM EST) -- NEW ORLEANS — Because a claims administrator’s denial of benefits was supported by substantial medical evidence and because the district court erroneously gave more weight to the claimant’s treating physicians, the Fifth Circuit U.S. Court of Appeals on Dec. 16 reversed a district court’s ruling entered in favor of the claimant (Alvin Schiro v. Office Depot, et al., No. 15-30066, 5th Cir.; 2015 U.S. App. LEXIS 22331).
