Federal Judge Finds Mode-Of-Operation Principle Applies In Slip-And-Fall Suit

(January 6, 2016, 2:12 PM EST) -- TRENTON, N.J. — A federal judge in New Jersey on Dec. 23 denied a water park’s motion for summary judgment in a slip-and-fall suit brought by a woman who injured herself when she slipped on a mat used for a water slide, after determining that the mode-of-operation principle applies to the suit (Kimberly Lenherr v. The Morey Organization, Inc., et al., No. 13-4731, D. N.J.; 2015 U.S. Dist. LEXIS 171360).
