6th Circuit: Tribe Can Prosecute Member For Off-Reservation Sex Crime

(January 6, 2016, 10:18 AM EST) -- CINCINNATI — A Native American tribe has jurisdiction to try a tribal official for an alleged sexual assault that happened off the reservation because the tribe “has not been expressly or implicitly divested of its inherent sovereign authority to prosecute members when necessary to protect tribal self-government or control internal relations,” the Sixth Circuit U.S. Court of Appeals held Jan. 5 in reversing a federal court ruling (Norbert J.
