Federal Judge: Denial Of Class Certification Doesn’t Doom Federal Jurisdiction
(January 6, 2016, 8:04 AM EST) -- KANSAS CITY, Mo. — A Missouri federal judge on Dec. 22 denied a renewed motion to remand a suit accusing a newspaper publisher of double billing some of its customers, finding that a determination of federal jurisdiction under the Class Action Fairness Act (CAFA) survives even after class certification was denied (Elizabeth O’Shaughnessy, et al. v. Cypress Media, LLC, No. 13-947, W.D. Mo.; 2015 U.S. Dist. LEXIS 171389).
