Insured’s Prior Knowledge Bars Coverage For Malpractice Claim, Panel Affirms

Mealey's (January 5, 2016, 2:25 PM EST) -- TOPEKA, Kan. — A Kansas appeals court on Dec. 23 held that a claims-made insurance policy’s prior knowledge provision precluded coverage for an underlying $3,905,000 legal malpractice judgment against an attorney insured (Daniel Becker v. The Bar Plan Mutual Insurance Co., No. 113,291, Kan. App.; 2015 Kan. App. Unpub. LEXIS 1114).
