Parties Complete Briefing On Remand Standard In 4th Circuit Asbestos Case

(January 5, 2016, 1:42 PM EST) -- RICHMOND, Va. — Parties recently finished briefing the Fourth Circuit U.S. Court of Appeals over whether a judge ignored overwhelming precedent in remanding an asbestos case or whether allowing removal would have required believing that Navy officers told the defendant to ignore federal regulations and contracts (Deborah H. Ripley, as administrator of the estate of Bernard W. Ripley v. Foster Wheeler LLC, Foster Wheeler Energy Corp., and J Henry Holland Corp., et al., No 15-1918, 4th Cir.).
