On Remand, False Claims Suit Against Device Maker Is Dismissed With Prejudice

(January 5, 2016, 11:18 AM EST) -- BOSTON — After a remand from a federal appeals courts, a Massachusetts federal judge on Dec. 30 again dismissed with prejudice a False Claims Act lawsuit filed by a former employee against the manufacturer of two medical devices for off-label sales (United States of America, ex rel. Jeffrey D’Agostino v. EV3, Inc., et al., No. 10-11822, D. Mass.; 2015 U.S. Dist. LEXIS 173025).
