Judge Won’t Certify Questions About Brand-Name Drug Makers To Kentucky High Court
Mealey's (January 4, 2016, 12:51 PM EST) -- FRANKFORT, Ky. — A Kentucky federal judge on Dec. 15 refused to certify questions about brand-name drug manufacturer liability in a Reglan/metoclopramide case to the Kentucky Supreme Court, saying the Sixth Circuit U.S. Court of Appeals has already ruled twice on the issue (Harold Neeley, et al. v. Wolters Kluwer Health, Inc., No. 15-54, E.D. Ky., S. Div.; 2015 U.S. Dist. LEXIS 167256).
