11th Circuit: Tribe’s Suit Fails To State RICO Claims Against Former Leader

(December 31, 2015, 2:22 PM EST) -- ATLANTA — A Florida Indian tribe’s fraud- and embezzlement-related Racketeer Influenced and Corrupt Organizations Act (RICO) claims against former tribal officials, several attorneys, a law firm and an investment firm were properly dismissed for failure to state a claim, even though the trial court erred in finding that it lacked jurisdiction because the claims represent an intratribal dispute, the 11th Circuit U.S. Court of Appeals ruled Dec. 22 (Miccosukee Tribe of Indians of Florida v.
