Judge: Drug Maker’s Records Are Not Newly Discovered Evidence In Fraud Case

(December 30, 2015, 2:44 PM EST) -- DETROIT — A drug manufacturer’s records documenting what drugs were purchased and returned by a number of pharmacies owned by a man convicted of conspiracy to commit health care fraud are not newly discovered evidence supporting his request for a new trial, a federal judge in Michigan ruled Dec. 28, noting that the records were available during pretrial discovery (United States of America v. Babubhai Patel, Nos. 11-20468, 15-13230, E.D. Mich.; 2015 U.S. Dist. LEXIS 172005).
