Appeals Court Reverses Ruling Denying Individual Unit Owners’ Motion To Intervene

(December 30, 2015, 10:02 AM EST) -- SANTA ANA, Calif. — A California appeals panel on Dec. 22 overturned a trial court judge’s decision to deny nine condominium owners’ motion to intervene in a lawsuit brought by their homeowners association over plumbing defects, ruling that the judge failed to consider when the individual unit owners learned that their interests in the litigation were not being adequately represented (Ziani Homeowners Association v. Brookfield Ziani LLC, et al., No. G050284, Calif. App., 4th Dist., Div. 3; 2015 Calif. App. LEXIS 1148).
