Stores To High Court: Patent Owner Waived Challenge To Willfulness Standards
Mealey's (December 29, 2015, 12:25 PM EST) -- WASHINGTON, D.C. — Toy stores in a patent infringement lawsuit argue in a Dec. 11 opposition brief to the U.S. Supreme Court that a toy manufacturer knowingly waived any challenge to In re Seagate Tech., LLC (497 F.3d 1360 [Fed. Cir. 2007]) and willfulness standards (Innovention Toys LLC v. MGA Entertainment Inc., et al., No. 15-635, U.S. Sup.).
