6th Circuit Vacates Denial, Awards Short- Term Benefits In ERISA Case
(December 21, 2015, 8:15 PM EST) -- CINCINNATI — A decision by a Michigan federal judge to affirm a denial of disability benefits was vacated on Dec. 9 by the Sixth Circuit U.S. Court of Appeals, which instead awarded the plaintiff partial short-term disability benefits and remanded the remainder of the dispute “for a full and fair review” under the Employee Retirement Income Security Act (Donald Godmar v. Hewlett-Packard Company, et al., No. 15-1480, 6th Cir.; 2015 U.S. App. LEXIS 21467).
